Supreme Court Ruling: Can Property Be Sold via GPA in India?
A common legal misconception in India is that a buyer can "purchase" real estate property simply by obtaining a General Power of Attorney from the seller without executing a registered Sale Deed.
In the landmark judgment Suraj Lamp & Industries Pvt. Ltd. vs. State of Haryana (2011), the Supreme Court of India conclusively ruled:
- A Power of Attorney is NOT an instrument of transfer of title. An immovable property (land, flat, commercial building) cannot be legally bought or sold through a GPA, Agreement to Sell, or Will.
- Title ownership of real estate can ONLY be transferred through a registered Sale Deed executed under Section 54 of the Transfer of Property Act, 1882.
